3. These terms
By using this website or placing an order you agree to these terms. If you do not agree, please do not use the site.
We may update these terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order.
4. Products
We sell padel bags and padel accessories. Product descriptions, dimensions and weights are given as accurately as we can.
Colours shown on screen may differ slightly from the physical product because of screen calibration and photography, and small variations between production batches are normal. Colour is the reason most people buy a NomadX bag, so if the colour is not what you expected our 30-day exchange in section C of the Returns Policy is there for exactly that.
Our bags are designed in South Africa and manufactured in China.
5. Prices
All prices are in South African Rand.
We are not currently registered for VAT, so no VAT is added to the prices shown. If our VAT registration status changes we will update the prices and this page, and the price shown at the moment you order is the price you pay.
Prices exclude delivery unless the order qualifies for free delivery under our Delivery Policy. The full amount payable, including any delivery charge or remote-area surcharge, is shown in your cart before you pay.
We try hard to ensure prices are correct. If a product is listed at an obviously incorrect price because of an error, we may cancel the order and refund you in full rather than supply at that price. We will contact you before doing so.
Promotional prices apply only for the period stated and cannot be combined with other offers unless we say so.
6. Orders
Placing an order is an offer to buy. A contract comes into existence only when we accept your order, which happens when we send you a dispatch confirmation. Receiving an order confirmation email is not acceptance.
We may decline an order if the item is out of stock, if we cannot verify your details, if we suspect fraud, or if there has been a pricing or description error. If we decline your order after you have paid, we refund you in full.
7. Payment
Payment is processed by Payfast, a South African payment provider.
You can pay by credit card, debit card, American Express, Instant EFT, Apple Pay, Google Pay or Mobicred. The methods available are shown at checkout.
Your payment details are entered on Payfast's own secure systems. We do not receive, see or store your card details at any point. Card data is encrypted in transit.
Mobicred is a credit facility provided by that company, not by us. Its own terms, credit checks and repayment schedule apply between you and it. We are paid in full at the time of your order and we are not a party to your credit agreement.
Your order is processed only once we receive verified confirmation of payment from Payfast.
8. Delivery
Delivery terms are set out in our Delivery Policy, which forms part of these terms.
Risk in the goods passes to you on delivery.
9. Returns and cancellation
Your rights are set out in our Returns, Exchanges and Cancellation Policy, which forms part of these terms and includes your statutory rights under the Consumer Protection Act and the Electronic Communications and Transactions Act.
10. Quality guarantee and warranty
Products are covered by the statutory quality guarantee in section 56 of the Consumer Protection Act. For six months from delivery you may return goods that are defective, unsafe or not as described, and you choose whether you want a repair, a replacement or a refund. We carry the cost and the risk of that return.
If we repair something and it fails again within three months of that repair, we will replace it or refund you, as section 56(3) of the Act requires.
We do not currently offer any warranty beyond that statutory six-month period.
Manufacturing defects are covered. Fair wear and tear, damage caused by misuse, accident, neglect or unauthorised repair, and the normal deterioration of materials over time are not.
11. Intellectual property
The NomadX name, logo, product designs, photography and website content are our property or licensed to us. You may not reproduce, distribute or use them commercially without our written permission.
12. Acceptable use
Please do not attempt to gain unauthorised access to this website, interfere with its operation, or use it for any unlawful purpose. Unauthorised access to a computer system is an offence under Chapter 13 of the Electronic Communications and Transactions Act.
13. Limitation of liability
Nothing in these terms limits your rights under the Consumer Protection Act, or excludes liability for death, personal injury or fraud where the law does not permit exclusion.
Subject to that, we are not liable for indirect or consequential loss, and our total liability in respect of any order is limited to the amount you paid for that order.
14. Circumstances beyond our control
We are not liable for delays or failure to perform caused by events outside our reasonable control, including courier disruption, load shedding, customs delays, natural events, strikes or civil unrest.
15. Complaints and dispute resolution
Please contact us first at info@nomadxsport.com or on 072 242 0390 so that we can try to resolve the matter. We aim to acknowledge every complaint within one business day and to resolve it within ten business days.
If we cannot resolve it, you may refer the dispute to the National Consumer Commission, or to a recognised consumer ombud or alternative dispute resolution agent as provided for in the Consumer Protection Act. Referring a dispute costs you nothing and does not affect any other right you have.
16. Privacy
We process personal information in line with our Privacy Notice, which forms part of these terms.
17. Governing law
These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
